The following Terms & Conditions form the basis of the understanding between you (a private individual) and Playsims Publishing Ltd in respect of the sale and purchase of goods through this website.
Security, Data Protection & Privacy
Playsims Publishing Ltd follows strict security procedures in the storage and disclosure of information that you have given us. This is to prevent unauthorised access or unlawful processing of your personal information. We keep your information confidential and store it on a secure server which is password protected and hidden behind a firewall from the outside world. We use secure socket layer software (SSL) to encrypt all of your personal information including your credit card number and your name and address.
Product Information
We will provide you with clear, up to date, and accurate information about our products and services, which complies with the conditions of the British Code of Advertising and Sales Promotion [www.asa.org.uk], and any additional guidelines advised by the Department of Trade and Industry. Furthermore, we will comply with any rulings given by the ASA, or DTI on any complaints raised with them.

Pricing
Prices stated in GBP (Sterling) include VAT (Value Added Taxes). For customers making purchases from outside the EU, VAT will removed from your order total prior to payment.
Please Note: Playsims Publishing Ltd reserves the right to amend the pricing for products on this website at its sole discretion.
Value Added Taxes (VAT)
Playsims Publishing Ltd charges VAT at the prevailing UK rate (currently 17.5%) on all products purchased through this website by customers in European Union (EU) countries only. Playsims Publishing Ltd does not charge VAT on orders from customers outside the EU.
Shipping
All prices exclude shipping/handling costs which will be added according to your preferred shipping method and will be confirmed with you prior to acceptance of your order.
Please Note: Playsims Publishing Ltd reserves the right to amend the shipping costs on this website at its sole discretion.
Payment
Playsims Publishing Ltd is able to accept payment in Sterling (GBP) only.
You can make payment to us by debit card (Visa debit, Delta, Solo, Switch, Maestro (UK only)) or credit card (Visa, Mastercard).
Ordering
To place an order via this website, click on the 'Add to Cart' button on the appropriate product page and follow the instructions given. Once you have completed your order and selected your method of payment, we will confirm acceptance both onscreen and by email. In exceptional circumstances we reserve the right to refuse your order, in which case we will promptly notify you and advise our reasons.
VFR Generation X User Discount
"Discount" in these Terms & Conditions means the VFR Generation X Registered User Discount.
The headings in these Terms & Conditions are provided for ease of reference only and should not be interpreted legally.
Entitlement
The Discount is provided at the sole discretion of Playsims Publishing Ltd.
If you are a registered VFR Generation X user and you are using your VFR Generation X products in accordance with the End User License Agreement then you are entitled to the Discount.
VFR Generation X Registered User Discounts may be claimed against products on special offer, or in a sale, however the VFR Generaton X User Discount may not be redeemed in addition to any other discount voucher. If you enter a discount voucher code in the box provided in Step 2 of 3 of the checkout process, this will automatically override the VFR Generation X Registered User Discount.
In order to claim the Discount the email address for your product registrations MUST be the same as the email address used to log in to this website.
Important: Please note that discounts may not be claimed retrospectively. All VFR Generation X User Discounts to be applied to your order will be displayed in the section entitled "Your Total" in Step 2 of 3 of the checkout, and again in the order totals displayed under "Shopping Cart Contents" in Step 3 of 3. If the 'Total' price stated is not as you expect it to be, please DO NOT complete your order. Any questions with, or problems regarding discounts should be directed to support@playhorizon.co.uk. We regret that we are unable to refund discounts after an order has been placed.
Restrictions
The Discount applies to ALL products featured on this website.
The Discount will be applied to the total value of the products (only) in your Shopping Cart at the time you pass through the Checkout.
The Discount does not affect shipping costs, which will be chargeable at the standard rate, according to weight and destination.
The Discount may not be used in addition to a Discount (voucher) Code that has been issued. Instead the Discount Code will override the Discount and will be credited to your order instead.
Validity & Termination
The Discount offer is valid until 30/06/10.
The Discount offer may be extended after 30/06/10 at Playsim Publishing Ltd's sole discretion, but may be terminated after this date immediately without cause or notice.
The Discount is for registered VFR Generation X users only. If you terminate your registrations (e.g. you sell your VFR Generation X products to another user) then your Discount will be terminated. Please note that products may not be re-registered to another user in the case that ownership of such products is passed to an individual other than the original registered user.
Exchange
The Discount has no cash value and may not be exchanged for cash or other credit.
Product Guarantee, Returns & Refunds
Our Product Guarantee means that if for any reason you are unhappy with your purchase, you can return it to us in its original condition within 30 days of the date you received the item, unopened (with any seals and shrink-wrap intact) and we will issue a full refund for the price you paid for the item (less any delivery costs).
Please Note: Playsims Publishing Ltd can only accept the return of opened items if they are faulty.
If you would like to return a product purchased through this website, please [Contact Us] to notify us of your intention and to request a Returns Number.
When we have agreed to exchange or refund your purchase, you will be issued with a Returns Authorisation number which must be quoted when returning any item to us. You must return the item to us promptly. We must receive the goods back within 7 days (for UK residents) or 14 days (overseas residents), of your receipt of the returns authorisation. If we receive goods back outside of these time limits, or without correct authorisation, we may not be able to process your refund or exchange.
Please Note: It is your responsibility to ensure the safe return of products to Playsims Publishing Ltd. If you are concerned about the product reaching us in time, or would like to track delivery, we recommend you use a recorded delivery service. Any costs involved in returning items to Playsims Publishing Ltd will be your costs, unless a product is faulty, or has been sent to you in error
Statutory Rights
Nothing in these Terms & Conditions affects your Statutory Rights. By law, you have the right to withdraw from your purchase within seven working days of the day after the date the item is delivered to you. This applies to all of our products. We regret however that we cannot accept cancellations of contracts for the purchase of software products where the item has been unsealed.
Please also be aware that once we begin the delivery process you will not be able to cancel any contract you have with us for additional services carried out by us (e.g. additional costs incurred and charged to you in respect of postage & packaging).
As soon as we receive items delivered to you under this cancellation right, we will refund the relevant part of the purchase price for that item, subject to the conditions described above.
Liability
Playsims Publishing Ltd will only be held liable for any loss or compensation beyond the amount charged to you for any failure on our part to deliver goods ordered by you as the UK Sale of Goods Act 1979 makes provision for. In essence this is the difference in cost directly and naturally occurring from you purchasing the same goods elsewhere as a result of our failure to deliver. No warrantees or conditions express or implied are given as to the accuracy or fitness of our products for any purpose (in particular use in flight training applications). For Clarity: Playsims Publishing Ltd's products are not certified training aids. You acknowledge and accept that your use of such products is entirely at your own risk.
Applicable Law
These Terms of Use will be deemed to be governed and construed in accordance with the Laws of England & Wales.
Illegality & Unenforceability
If any of these Terms of Use should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms of Use are intended to be effective, then to the extent and within the jurisdiction in which that Term is illegal, invalid or enforceable, it shall be severed and deleted from the clause concerned and the remaining Terms shall survive, remain in full force and effect and continue to be binding and enforceable.
